The new edition (9th) of the International Nice Classification of products and services for the purposes of registering marks came into force on the 1st January 2007.
The new Nice Classification comprises 45 Class Headings which describe in very broad terms the nature of the goods or services contained in each of the 34 classes of goods and 11 classes of services.
The Class Heading are accompanied by Explanatory Notes which describe in greater detail the type of product or service included in each class, and an Alphabetical List of Goods (10.000 indications) and another of Services (1.000 indications), with the class in which each product or service is placed.
The registry of marks (national, community, international) is convenient to distinguish products and services in the market and to identify their entrepreneurial origin, but is also very advisable to protect the registry and use of Internet Domain Names, as the trademark is identical or similar to the domain name.
In the case of either recovering a domain name registered by a third party or defending its registry in front of a third party which claims they are more entitled to the use of that domain name, it will be very important, although not decisive, to have a trademark for the success of the recovery of the domain name in conflict or the defence of its registry and use.
